WARRANTY AND CONDITIONS OF SALE:
The Sweet Tomato Test Garden warrants that the products and seed it sells conform to the label description as required by federal and state seed laws. We make no other warranties, express or implied, of merchantability, suitability for a particular purpose, or otherwise. It is recognized that a mistake can be made in the production, processing, or packaging of such products and seed. Because seed is a living product and its performance can be affected by factors which are beyond our control and the control of buyer. Accordingly, LIABILITY FOR DAMAGES FOR ANY CAUSE, INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY AND NEGLIGENCE, WITH RESPECT TO OUR PRODUCTS AND SEEDS PURCHASED FROM US IS LIMITED TO A REFUND OF THE PURCHASE PRICE OF THE PRODUCT OR SEEDS. THIS REMEDY IS EXCLUSIVE. IN NO EVENT SHALL WE BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS.
When you place your order you agree to our terms and conditions of sale. Any changes or additions to these terms must be in writing and signed by an officer of the Sweet Tomato Test Garden.
